I. Forms of Trademark

II. Process for Hong Kong Trademark Registration

2. Preliminary advice on registrability: on the basis of this search, preliminary advice on registrability could be obtained, since this initial search could check if the trademark has been registered by others and there are any other similar trademarks.

3. Submit the trademark application: there are certain requirements on the format for documents, so you need to check if all of those have been met: a clear drawing of the trademark, a category of the goods or services, filing fee for at least one class of goods or services and authorization letter of registration.

4. Notice of Acceptance: issued by HongKong Intellectual Property Department, once your application has been submitted and accepted.

5. Examination: The application is forwarded to an examining attorney, after Hong Kong Intellectual Property Department thinks your application has met the basic requirements. Then the examining attorney will reviews the application to determine whether it complies with all applicable rules and statutes and includes all required fees.

6. Publication: If the examining attorney raises no objections to registration, or if the applicant overcomes all objections, the examining attorney will approve the Hong Kong Trademark for publication in the Official Gazette, which is 3 months publication of the Hong Kong Intellectual Property Department.

7. Registration: If no party files an opposition or requests to extend the time to oppose, the Hong Kong Intellectual Property Department will normally register the mark and issue a registration certificate. The date of filing the application will be the registration date.

III. Hong Kong Trademark Registration Time-frame
The approximate time for obtaining the registration certificate of Hong Kong Trademark is about 6 months for smooth application. The term of validity is 10 years from the date of filing the application, in which period no extra fee is imposed.
