Hong Kong Standard Patent Application

Hong Kong standard patent application is filed with the Patents Registry of the Intellectual Property Department. Applying for a patent elsewhere in the world or in other regions of China does not automatically give you protection in Hong Kong, China. Protection under standard patents is renewable annually after the end of the third year, for a maximum of 20 years.

Hong Kong Innovation and Technology Commission promotes a Hong Kong Patent Application Grant, which is a funding scheme to assist local companies and individuals to apply for patents of their own inventions and utility models. For an approved application, the applicant will be granted an amount of up to HKD250,000.

Eligibility on Applicant
If you are the owner of the invention, you can apply for a patent. If you apply for a standard patent in Hong Kong, China but you are not the applicant named in the designated patent application, you will need to file a statement and supporting documents (for example a copy of an assignment document) explaining your right to apply.

Language for Application
You can file your application in English or in Chinese. Patents application forms are available in either language. Certain information in your application must be shown in both languages. You will need to give the title of the invention and abstract in both English and Chinese. If the applicant's or inventor's names are not in Roman letters or in Chinese, you will need to give a transliteration of the names in Roman letters.

Applying for a Standard Patent in Hong Kong
The grant of a standard patent in Hong Kong is based on the registration of a patent granted by one of three patent offices:
1. the State Intellectual Property Office, People's Republic of China;
2. the European Patent Office, in respect of a patent designating the United Kingdom;
3. the United Kingdom Patent Office.

A standard patent application in Hong Kong is made in two stages by filing:
Stage 1: a request to record the designated patent application, that is the Chinese, EP(UK) or UK published patent application.
Stage 2: a request for registration and grant in Hong Kong, China of the Chinese, EP(UK) or UK granted patent.

Required information
1. Chinese and English names of the invention;
2. Name and address of the applicant;
3. Name and address of the inventor;
4. Patent documents;
  (1) Claim: describe the protection scope of the patented technology;
  (2) Abstract: provide the outline of the key technical aspect of the patent;
  (3) Specification: provide written details and features of the patented technology;
  (4) Drawings: illustrate structures or details of the patent.
5. Copy of the letter of publication of the application;
6. Chinese and English translations of relevant materials and documents.
