Q: What materials are required for application?
(1) Corporation Applicant: Business Registration Certificate or Certificate of Incorporation;
(2) Individual Applicant: Identity documents and address proof;
(3) Application form;
(4) Trademark image;
(5) List of goods and services.
Q: How to classify my goods and services?
Under the Trade Marks Ordinance (Cap.559), goods and services shall be classified for the purposes of the registration of trade marks according to the Nice Classification. There are 45 classes of goods and services in the current edition of the Nice Classification.
Q: What will be the following process after filing the application?
There are four stages in the process of examining an application for registration:
(1) deficiency checking;
(2) examination against the requirements of the Trade Marks Ordinance;
(3) acceptance and publication for opposition;
(4) registration and issue of certificate of registration.
Q: How long will the whole trademark application process take?
Upon receipt of the application, the examiner will process the application according to the Trade Marks Ordinance and Trade Marks Rules. If there is no deficiencies and no opposition, the whole process (from receipt of application to the application being approved) will take as short as six months.
Q: What will be the language in the certificate of registration?
Generally, if you file an application in Chinese, the certificate of registration will be in Chinese. Similarly if you file the application in English, the certificate of registration will be in English.
