Trademark renewal must be done before it expires. Once a trademark has been registered in China, it is valid for ten years. The 10 years are counted from the day of registration. The China trademark office will not notify you of these requirements. It is completely your obligation to know the renewal deadline and meet it. If you miss renewal deadline your trademark registration will be canceled without notice. Then you have to go through the trademark registration process all over again.
I. China Trademark Renewal Timeline
The trademark owner can renew the mark within 1 year before the expiration date. If the mark is not renewed in time, the trademark can still be renewed in a grace period of 6 months after the expiration date. If still no renewal application be filed in the grace period, it will be canceled by the China Trademark Office.
II. Requirements for China Trademark Renewal
1. A copy of China trademark certificate of registration;
2. Business Registration (BR) or ID cards of trademark owner(Individual requires the personal, while the company requires the company certificate/business license);
3. Contact Information (including telephone, fax, and email).
III. China Trademark Renewal Application
Application for renewal of registered trademark shall be filed with the Chinese Trademark Office within 6 months before the expiration of the period of validity.
If no application is filed within said period, a grace period of 6 months is allowed with a payment of surcharge. If there is still no renewal application filed within the grace period, the registration will be canceled.
Upon approval, the Trademark Office will issue relevant certificate to the trademark registrant.
The application procedures are as follows:
1. Provide the document files.
2. Send the trademark renewal & invoice letter.
3. Confirm the trademark renewal application, sign an entrustment agreement and power of attorney for trademark renewal application, and pay the bill.
4. Submit the application files to China Trademark Office.
5. A substantive examination will be made by China Trademark Office within eight months.
6.The trademark renewal will be approved by China Trademark Office if pass the substantive examination.
7. Get the trademark renewal certificate.
IV. Validity of China Trademark Renewal
The renewal of each registration will be valid for ten years.
