China trademark post registration service provided by Tannet include owner’s information change, trademark monitoring, trademark renewal, trademark assignment/transfer and trademark infringement. How to prevent someone else registering a trademark similar or identical to your mark in China? The best way is to have your mark registered as early as possible. Tannet can help you conduct the preliminary search and file the trademark application with the State Intellectual Property Office. The following are a brief introduction to Tannet’s post registration services on trademark.

Owner’s Information Change
According to the China Trademark Law, once the trademark owner changes his/its name or address, the trademark modification application shall be filed to re-fresh the official record. The Modification application helps better protect your trademark exclusive right. Types of modification are as follows:
1. Name change of the applicant/trademark owner;
2. Address change of the applicant/trademark owner;
3. Change the representative (refers to Chinese attorneys/agents).

Trademark Monitoring
Trademark monitoring is an integral part of a trademark protection strategy. Usually trademark offices do not check if there are older similar trademarks and register an application even if there is a likelihood of confusion. Trademark owners need to monitor all new application so that they can file an opposition in case of a likelihood of confusion. Our professionals can help you trace your trademark in China and alert you of a potential infringement.

Trademark Assignment/Transfer
Trademark assignment/transfer refers to changing trademark ownership from A to B. The assignor and assignee need to file assignment application with China Trademark Office (CTMO), and after approval, CTMO will issue a certificate of assignment. The assignee B could use the certificate of assignment together with the original registration certificate to testify that it is the current registrant of concerned mark.

All in all, except trademark application, one can obtain trademark ownership through assignment only. And the assignee could finally own the concerned mark with exclusive and complete right only after obtaining approval of CTMO.

Trademark Renewal
The registered trademark has the validity of 10 years from the registration date in China. The trademark owner can request to renew the mark within 1 year before the expiration date. If the mark is not renewed in time, the trademark can still be renewed in the grace period of 6 months after the expiration date. If the trademark is still not renewed in the grace period, it will be canceled by the China Trademark Office, irreversibly.

Requirements for trademark renewal in China:
1. Scanned copy of trademark owner's identity certificate (business license);
2. Scanned copy of the trademark registration certificate;
3. Official fee for the trademark renewal.

Apply for registration is the first step to protect your trademark rights in China, because China adopts principle of first to file, it’s quite different to the principle of first to use which adopted in other countries.
