Appearance design refers to the appearance design of industrial products, that is, the pattern of industrial products. Appearance design is used to protect the visible shape, style, decoration, or appearance of an object. Article 2 of the Detailed Rules for the Implementation of the Patent Law states: "Appearance design refers to a new design that is aesthetically pleasing and suitable for industrial application made on the shape, pattern or the combination of these and the combination of color, shape and pattern. Appearance design must be kept secret and not made public until the application is submitted. Otherwise, the registration may be invalid.
Documents required for Chinese Design Patent Application:
1) Personal ID card (copy) for individual application;
2) A copy of the business license (copy) applied by the enterprise (for overseas patent applications, the English name and address of the applicant should also be provided);
3) ID card of the designer (copy) (for overseas patent applications, the English name and address of the designer should also be provided);
4) Two copies of the picture, the picture must be drawn by computer or formal drawing tools. For products involving six faces, six orthographic views shall be provided, namely front view, rear view, top view, up view, left view and right view (graphic size: 3×8-- 15×22); Products involving one or more surfaces, providing orthographic views and stereograms of the covered surfaces; A planar design involving only one face, providing an orthographic view of that face.
Application time: 8-10 months
Validity: Renew every year for 15 years
Special Reminder:
The latest exemption basis after July 1, 2019: Annual income of domestic individuals around 60,000 RMB, taxable turnover of domestic companies in the previous year around 1 million; After submitting the application, can get the "Patent Acceptance Notice" in about one week; Within about six months, the Intellectual Property Office will issue the "Notice of Granting Design Patent Right" and the "Notice of Going through Registration Procedures"；After paying the patent registration fee and annual fee, the patent will be issued in about two months.
