China’s Negative List and Foreign Investment Encourage Catalogue

Foreign investors follow the country’s negative lists and encouraged catalogue, which are advised to use these negative lists and encouraged catalogues to better understand restricted or prohibited sectors and sectors open to foreign investors, respectively.

Foreign investors should pay attention:
Entry into the Chinese market is regulated by country’s negative lists and encouraged catalogue, so foreign players must aware that in what specific sector-based investment foreign-invested enterprises (FIE) can access of:
      1) Negative lists directed at foreign investors; and
      2) General negative lists, ( for all enterprises including domestic enterprises)


Thus, foreign business must keep an eye on the four lists,
       1)• The Special Administrative Measures on Access to Foreign Investment (2019 edition) (“2019 FI national negative list”) (Full list in Chinese available here); and
       2)• The Free Trade Zone Special Administrative Measures on Access to Foreign Investment (2019 edition) (“2019 FI FTZ negative list”) (Full list in Chinese available here).
Above lists are applied to foreign investors.


       3)• The Negative List for Market Access (2019 edition) (“2019 MA negative list”) (Full list in Chinese available here); and
       4)• The Catalogue for Guiding Industry Restructuring (2019 edition) (“2019 guidance catalogue”) (Full list in Chinese available here).
Above lists are applied to all investors.


Moreover, it is critical to keep in track of these lists, as well as positive list.
         Foreign capital is encouraged to enter the sectors listed in The Catalogue of Encouraged Industries for Foreign Investment 2019 (“2019 FI encouraged catalogue”) (Full list in Chinese available here).
