Trademark registration in Hainan is a good way to protect your brand. Hainan is the smallest and southernmost province of China, consisting of various islands in the South China Sea. It is the largest and fifth most populous island under PRC control. Trademark is the brand of a product that we often say. It is a kind of identification mark to identify the source of goods (or services). China adopts “first-to-file” principle. Therefore, the earlier you file the application, the better it will be.

Required Information
(1) Business Registration Certificate / Certificate of Incorporation (for corporation applicant);
(2) ID card, passport or other valid identity certificates (for individual applicant);
(3) Application form and Power of Attorney (provided by Tannet);
(4) Trademark drawings;
(5) List of goods and services.

Procedures for Registration Trademark
1. Trademark Search
Before filing the application, it is recommended to search for the trademark in order to avoid the conflict trademarks that may lead to the refusal.

2. Submit the application
Foreign applicants without residency or place of business in China are required to submit trade mark applications through a local Chinese trade mark agent who will deal directly with the State Intellectual Property Office (SIPO).

3. Examination
After the SIPO determines that you have met the minimum filing requirements, the application is forwarded to an examining attorney. This may take a number of months. The examining attorney reviews the application to determine whether it complies with all applicable rules and statutes.

4. Opposition
After acceptance, a trademark application will be published for opposition in the official bulletin. The opposition period is 90 days.

5. Registration
If there is no opposition after the statutory period of 3 months from the date of publication, the  Certificate of Registration will be issued.

A trademark registration in China is valid for 10 years and starts with registration date. The registration is renewable for periods of 10 years.
